This directory lists electronic vaping devices that are certified by manufacturers that the device meets the requirements under sec. 995.15, Wis. Stats. Electronic vaping devices not listed on the directory that are sold, offered for sale, or possessed for sale in Wisconsin after September 1, 2025, may be seized and destroyed, and manufacturers and retailers may be penalized.
Exception: An electronic vaping device that contains hemp, as defined in sec. 94.55(1), Wis. Stats., and does not contain nicotine (hemp device), must be certified to the department no later than July 1, 2026, and annually thereafter. These devices cannot be sold or offered for sale in Wisconsin beginning July 1, 2026, if the device is not listed in the directory. Beginning September 1, 2026, a $1,000 forfeiture (per day for each device) is imposed on manufacturers and retailers that sell or offer for sale a hemp device not listed on the directory.
"Electronic vaping device" includes:
- A device that may be used to deliver any aerosolized or vaporized liquid or other substance for inhalation, such as an e-cigarette, e-cigar, e-pipe, vape pen, or e-hookah.
- A component, part, or accessory of such device.
- A liquid or other substance that may be aerosolized or vaporized by such device.
"Electronic vaping device" does not include:
- A battery or battery charger when sold separately.
- Drugs, devices, or combination products authorized for sale by the U.S. Food and Drug Administration, as those terms are defined in the Federal Food, Drug, and Cosmetic Act.
